When you access our website <a href=\"https:\/\/hygienemitsystem.at\"><em>www.hygienemitsystem.at <\/em><\/a>, the browser used on your device automatically sends information to our website's server. This information is temporarily stored in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted:<\/p>\n<ul>\n<li>IP address of the requesting computer, <\/li>\n<li>date and time of access, <\/li>\n<li>name and URL of the retrieved file, <\/li>\n<li>website from which access is made (referrer URL), <\/li>\n<li>browser used and, if applicable, the operating system of your computer as well as the name of your access provider, language and version of the browser software <\/li>\n<\/ul>\n<p>We process the aforementioned data for the following purposes:<\/p>\n<ul>\n<li>ensuring a smooth connection to the website, <\/li>\n<li>ensuring convenient use of our website, <\/li>\n<li>evaluating system security and stability, and <\/li>\n<li>for other administrative purposes. <\/li>\n<\/ul>\n<p>The legal basis for the data processing is Art. 6(1)(1)(f) GDPR. Our legitimate interest follows from the purposes of data collection listed above. Under no circumstances do we use the collected data for the purpose of drawing conclusions about you personally.<\/p>\n<p>In addition, we use cookies when you visit our website. Cookies do not cause any damage to your computer and do not contain viruses. Further explanations can be found in section 5 of this privacy notice.<\/p>\n<h4>b) When using our online shop<\/h4>\n<p>When you use our online shop, e.g. by submitting your offers, by accepting our offers, by registering or through other communication, we process the personal data you provide exclusively for the purpose of initiating or performing a contract.<\/p>\n<p>The legal basis for the data processing is Art. 6(1)(1)(b) GDPR. According to this provision, data processing is necessary for the conclusion or performance of a contract to which the data subject is party, or in order to take steps at the request of the data subject prior to entering into a contract.<\/p>\n<p>When you use our online shop, we process the following personal data transmitted by you:<\/p>\n<ul>\n<li>first and last name (for businesses: company name) <\/li>\n<li>address <\/li>\n<li>telephone number (landline and\/or mobile number) <\/li>\n<li>fax number (only if available) <\/li>\n<li>email address <\/li>\n<li>IBAN (only if required to process payments) <\/li>\n<li>credit card number together with card verification code (only if required to process payments) <\/li>\n<\/ul>\n<p>This data is processed for the purpose of fulfilling our contractual obligations, in particular for shipping the goods, processing payment including invoicing, handling any warranty claims, and for any related correspondence with you.<\/p>\n<p>You may also voluntarily create a customer account in which we can store your personal data for later purchases. When you create an account under \u201cMy Account\u201d, the data you enter there is stored on a revocable basis. You can delete all other data, including your user account, in the customer area at any time.<\/p>\n<h4>c) When using our contact form<\/h4>\n<p>So that you can send us your questions, remarks, comments, etc., we have provided a contact form on the website. To use it, you must provide your email address and your name so that we know whom to reply to; you may provide further information voluntarily.<\/p>\n<p>The legal basis for the data processing is your voluntarily given consent (Art. 6(1)(1)(a) GDPR).<\/p>\n<p>The personal data we collect for the use of the contact form is deleted once your enquiry has been dealt with.<\/p>\n<h4>d) When subscribing to our newsletter<\/h4>\n<p>If you have expressly consented (Art. 6(1)(1)(a) GDPR), you can receive our newsletter, in which we inform you about current offers in the area of goods and\/or services. The goods and\/or services advertised in the newsletter are named in the declaration of consent. The only mandatory information for receiving the newsletter is your email address. Providing further, separately marked data is voluntary and is used to address you personally.<\/p>\n<p>For subscribing to our newsletter, we use the so-called double opt-in procedure. This means that after you subscribe, we send an email to the email address you provided, asking you to confirm that you wish to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store the IP addresses you used and the times of subscription and confirmation. The purpose of this procedure is to be able to prove your subscription and, if necessary, to investigate any possible misuse of your personal data.<\/p>\n<p>The legal basis for this data processing is your voluntarily given consent (Art. 6(1)(1)(a) GDPR).<\/p>\n<p>You can withdraw your consent to receiving the newsletter and unsubscribe from the newsletter at any time. For this purpose, you can send your unsubscribe request by email to the email address info@hygienemitsystem.at.<\/p>\n<h4>e) Processing based on legitimate interests<\/h4>\n<p>Where necessary for our business purposes, we process your data \u2013 apart from initiating or performing a contract and consent expressly given by you \u2013 to safeguard the legitimate interests of our company, unless a balancing of interests in the individual case shows that your legitimate fundamental rights and freedoms which require the protection of personal data prevail (cf. Art. 6(1)(f) GDPR). The legitimate interests of our company include:<\/p>\n<ul>\n<li>direct marketing, unless you have objected to the use of your personal data. <\/li>\n<\/ul>\n<\/div>\n<div class=\"hms-legal-document__card\">\n<h3>3. Disclosure of data to third parties<\/h3>\n<p>Your personal data will not be transferred to third parties for purposes other than those listed below. In particular, no disclosure to third parties takes place without your express consent, e.g. for advertising purposes.<\/p>\n<p>We only disclose your personal data to third parties if:<\/p>\n<ul>\n<li>you have given your express consent to this in accordance with Art. 6(1)(1)(a) GDPR; <\/li>\n<li>this is necessary under Art. 6(1)(1)(b) GDPR for the performance of contractual relationships with you, e.g. to credit institutions for processing the contractually agreed payments, to shipping and transport companies for the purpose of transporting goods including shipment tracking, or, in the event of non-payment of contractually agreed payments, to lawyers and legal service providers for the purpose of enforcing legal claims; <\/li>\n<li>there is a legal obligation for the disclosure under Art. 6(1)(1)(c) GDPR; or <\/li>\n<li>the disclosure under Art. 6(1)(1)(f) GDPR is necessary for the establishment, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in your data not being disclosed. <\/li>\n<\/ul>\n<p><em>Among other things, we offer payment via PayPal. Accordingly, the data will be deleted unless, for example, storage is necessary for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject (Art. 17(3)(b) GDPR), or for the establishment, exercise or defence of legal claims (Art. 17(3)(e) GDPR). Statutory retention obligations constitute a legal obligation; for example, under \u00a7 147(1) no. 4, (3) sentence 1 AO there is a retention period of 10 years for accounting data including order and payment data, and under \u00a7 257(1) nos. 2, 3, (4) HGB there is a retention period of 6 years for commercial correspondence, e.g. email messages. For the duration of the retention obligations, the data is blocked; after they expire, the data is deleted.<\/p>\n<\/div>\n<div class=\"hms-legal-document__card\">\n<h3>6. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, where applicable, meaningful information about its details; <\/li>\n<li>pursuant to Art. 16 GDPR, to request without undue delay the rectification of inaccurate personal data or the completion of your personal data stored by us; <\/li>\n<li>pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims; <\/li>\n<li>pursuant to Art. 18 GDPR, to request the restriction of processing of your personal data if you contest the accuracy of the data, if the processing is unlawful but you oppose its erasure, if we no longer need the data but you require it for the establishment, exercise or defence of legal claims, or if you have objected to the processing pursuant to Art. 21 GDPR; <\/li>\n<li>pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format, or to request its transmission to another controller; <\/li>\n<li>pursuant to Art. 77 GDPR, to lodge a complaint with a supervisory authority.
